Extended Producer Responsibility (EPR) is a policy approach that makes brand owners financially responsible for the end-of-life management of their packaging. Brands pay fees based on the weight and material type of packaging they put into commerce in regulated states.

Which states require EPR reporting?

California (SB 54), Oregon, and Colorado have active programs with reporting requirements now in effect. Minnesota, Maryland, and Washington are implementing their programs. Maine has a planning-stage program. More states are expected to adopt legislation in 2026–2027.

What data do I need to report?

Typically: the weight of each packaging component (primary, secondary, tertiary), material type (PET, HDPE, cardboard, etc.), post-consumer recycled content percentage, and sales volume into each state.
